The Lodwar Magistrate’s Court has convicted a man to life imprisonment for defilement and sexual assault of two minors aged 9 and 6 years old at Nakwamkwi in Turkana Central Sub-County. The accused, who was a neighbour, was found guilty after a thorough trial.
In a statement issued by the ODPP on October 10, 2025, the court heard that on various dates between July 17, 2023 and July 19, 2023, at Nakwamkwi in Turkana Central Sub-County, the man lured the two young girls to his house by offering them yoghurt and sweets.
"The 9-year-old victim testified that the defendant lured him to his residence, where he committed the indecent act upon her, providing a detailed description of the incident. The 6-year-old victim testified that she saw the defendant commit the act and later assaulted her," ODPP said in a statement.
Their testimony was supported by medical evidence and a neighbour who saw the 9-year-old running scared from the accused’s house.
"The minors' testimony was corroborated by medical evidence and a neighbour who saw the 9-year-old running scared from the accused's house, " the statement read.
"Lead Counsel Robert Otieno and Baranga Limo called five witnesses who “successfully proved the case beyond a reasonable doubt."
The court rejected the accused’s defense that he was away in Bungoma at the time of the incident, stating that his alibi was not proved and failed to displace the strong evidence from the prosecution’s witnesses, including the minors’ credible and consistent testimonies.
Justice Idagwa ruled that the accused was positively identified by the minors, as he was a neighbour known to them, making it a case of recognition.
"Satisfied with the evidence, the court found the accused guilty and sentenced him to life imprisonment," the statement read in part.
Section 8 of the sexual offences Act states that a person who commits an offence of defilement with a child aged eleven years or less shall, upon conviction, be sentenced to imprisonment for life.
