The High Court of Kenya has issued an order preventing Parliament from forwarding the Constitution of Kenya (Amendment) Bill, 2025, to President William Ruto for assent until a petition challenging the bill is fully determined.
Justice Lawrence Mugambi made this ruling after the Katiba Institute filed a petition alleging that the Bill’s content and the process followed violate constitutional principles, especially around public finance, accountability, and the requirement for a referendum in certain cases.
The Bill, sponsored by MPs Otiende Amollo and Samuel Chepkonga, seeks to entrench within the Constitution three funds: the National Government Constituencies Development Fund (NG-CDF), the Senate Oversight Fund (SOF), and the National Government Affirmative Action Fund (NGAAF).
