A petition has been filed at the Milimani High Court seeking to compel the government to hold the next General Election on Tuesday, August 11, 2026, which the petitioner argues is the constitutionally mandated date under the 2010 Constitution.

Bryson Mangla, a resident of Kajiado West sub-county, warns that failure to conduct the election on that date could result in violations of key constitutional provisions, including Articles 101(1), 136(2a), 177(1a), and 180(1).

"That time is running out because the nation has only 14 months to go before participating in the general elections envisaged on August 11, 2026," reads court papers.

He argues that any attempt to extend the current term of office beyond August 2026 would violate the political rights of voters under Article 38(2), and insists the Constitution replaced the five-year election cycle with a four-year term.

Mangla describes the idea of holding the General Election in 2027 as unconstitutional, warning that it amounts to “an act of treason.”

He further states that public officials who enable such a move risk being prosecuted and, if convicted, face capital punishment under the Penal Code.

The petition seeks a court declaration that the General Elections for President, Members of Parliament, Governors and County Assembly Members must be held on August 11, 2026,  the second Tuesday of the month.

He also wants the Independent Electoral and Boundaries Commission ordered to begin preparations for the 2026 elections and the National Treasury directed to allocate adequate funding for the process in the current and next financial years.

"An order that the CS National Treasury should provide IEBC with adequate funds in this financial year 2025/2026 and the next financial year 2026/2027 to facilitate the said election on Tuesday 11/08/2026," adds court papers.

Mangla says he previously issued a memorandum dated April 30, 2025, raising concerns about the election timeline, but received no response from any relevant institution.
