LSK warns of armed plot to disrupt protest memorial

The Law Society of Kenya has issued a warning against an alleged plan by political actors to recruit and deploy armed gangs to attack protesters during a memorial march for victims of the 2024 June 25 demonstrations, calling it a dangerous and unconstitutional threat to national peace and human rights.

LSK President Faith Odhiambo in a statement on Tuesday, said the reports were credible and called on national security organs to act swiftly.

“There is sufficient material in the public domain to justify the public apprehension that this ill-conceived plot not only exists, but may be at such an extensive scale that it threatens to plunge Kenya into anarchy,” she said.

Odhiambo pointed to a viral video of Tiaty MP William Kassait Kamket in which he allegedly threatened to bring armed bandits to Nairobi to attack demonstrators under the pretext of defending the government.

She said such threats directly violate the Constitution, which already provides structured and well-funded security organs tasked with protecting the state and citizens.

“It is inimical to the rule of law to pit Kenyans against themselves under the guise of protecting the state where adequate institutions exist,” Odhiambo said.

She noted that recent remarks from pro-government politicians have attempted to label youth-led protests as disorderly and unpatriotic, a narrative she described as dangerous and aimed at eroding the freedoms enshrined in the Constitution.

This narrative must be seen for what it is – an effort to diminish the human rights enshrined in the Bill of Rights, and undermine the political views and sovereign authority of the people of Kenya.”

‘A Criminal Conspiracy’

The LSK warned that such a plan, if not stopped, could seriously undermine Kenya’s democracy. Odhiambo said: “No right-thinking Kenyan should even remotely perceive such atrocities against the people of Kenya or deliberate violation of the Constitution and the fundamental human rights that make Kenya a democratic state.”

She expressed concern that individuals behind the threats remain free and are not under investigation, calling this inaction a sign of possible state complicity.

“These acts may amount to crimes against humanity under international law. No one is above the law, and political power offers no immunity from individual criminal responsibility for gross violations of human rights,” she said.

She urged the National Security Council to take urgent action. “There must be an elaborate, transparent and swift investigation into how far this criminal conspiracy runs, and all persons involved must be arrested and prosecuted to prevent their plan from materializing.”

Concern Over Disappearance

The Society also raised alarm over the disappearance of Ndiangui Kinyagi, whose home was allegedly raided by DCI officers and personal items confiscated.

“There is no record of his arrest in any police station, and his whereabouts remain unknown,” said Odhiambo.

She called for urgent investigations, saying his family is distressed and needs assurance of his safety. “They must be given an opportunity to see him and retain legal representation on his behalf should it be necessary.”

Odhiambo closed her remarks with a call for peace and unity saying:  “Let us not flush our country down the drain. We must jealously guard the semblance of stability we have enjoyed under our new constitutional dispensation; we owe it to ourselves, our nation and our future.”
