The Law Society of Kenya has filed an urgent petition in the High Court demanding the immediate production of activist Ndiangui Kinyangia, who was allegedly abducted by masked men believed to be plainclothes police officers in Kinoo.

The petition seeks a writ of habeas corpus compelling senior government and law enforcement officials to produce Kinyangia, who has not been seen or heard from since June 21, 2025.

According to court filings, the activist was seized by men in balaclavas carrying handguns and travelling in unmarked vehicles with distorted number plates. The family reported the incident at Kinoo Police Station under OB Number 16/23/06/2025 but say they have received no updates on his whereabouts or condition.

“No charges have been preferred against the 2nd Petitioner, nor has there been any formal arraignment in court,” the petition states. “This is a blatant violation of Article 49 of the Constitution and a breach of the Criminal Procedure Code.”

The petitioners argue that the disappearance is tied to Kinyangia’s vocal online activism and civic engagement, and that his detention—if confirmed—amounts to an illegal and incommunicado arrest.

They are also seeking a conservatory order restraining further abductions or unlawful detentions, and want top state officials summoned to court to explain the activist’s disappearance.

Citing Section 389 of the Criminal Procedure Code and key constitutional provisions, the petition warns that continued silence from the state risks undermining public trust and the rule of law.

“This Honourable Court has a duty to safeguard the rights not only of the 2nd Petitioner but of the public at large,” it reads. “The continued silence and inaction of the respondents is alarming, especially in light of recent public statements by senior officials denying knowledge of ongoing abductions.”
