I fear for my life,  Ndiang’ui tells court in plea to block arrest

Blogger Ndiang’ui Kinyagia has asked the High Court to continue shielding him from arrest, telling the court that he fears for his safety.

Speaking directly to Justice Chacha Mwita during a court session on Thursday, Ndiang’ui urged the judge to extend earlier orders that had stopped any police arrest.

"I request the court to extend the orders barring my arrest by the police," Ndiang’ui said, explaining that he genuinely feared for his life if taken by state officers.

His appeal came shortly after he resurfaced following an unexplained absence that lasted several weeks. He told the court he wanted to testify about what had happened to him during that time.

In response, Justice Mwita directed him to file an affidavit within 14 days detailing what occurred while he was missing.

The court, however, made it clear that any protection granted was not a free pass. Justice Mwita said the orders in place were only meant to protect the petition but did not stop legal action where necessary.

“You are reminded that the orders in place do not shield you from lawful arrest should there be valid grounds. The rule of law still applies,” the judge told him.

The Law Society of Kenya, which had earlier been part of his legal team, officially withdrew from the case, leaving Ndiang’ui to proceed without a lawyer.

Justice Mwita gave him 14 days to appoint an advocate and submit the affidavit explaining his disappearance. He added that the public and the court deserved to know the truth about what happened.

Meanwhile, the respondents and prosecution opposed any delay in the case, urging the court to proceed without further interruptions.

The matter will be mentioned again on September 16, 2025, when the court will check if its directions have been followed and give further instructions.
