Kasipul MP murder case consolidated as two more suspects join trial

The judge ordered that pre-bail assessment reports be prepared by a probation officer and filed within 30 days.
The murder case involving the killing of Kasipul MP Charles Ong’ondo Were has now taken a new direction after his bodyguard, Allan Omondi Ogola, and another suspect, Isaac Kuria alias Kush, were officially added to a trial that already includes three other accused persons.
Initially, Ogola and Kuria had been charged separately at the Milimani Law Courts, but their cases have now been merged with the existing file and transferred to the Kibera High Court.
They will now face joint charges alongside William Imoli alias Imo, Edwin Odhiambo alias Machuani, and Ebel Ochieng alias Dave Calo.
All five accused appeared before Justice Diana Kavedza on Tuesday, where they denied the murder charges brought against them.
Justice Kavedza confirmed that although the Judiciary will be on recess, a ruling on the bail applications for Imoli, Odhiambo, and Ochieng will still be delivered on August 14.
“We will be on recess, but the ruling on bail for the first three accused will still be delivered on August 14,” she said.
Kuria and Ogola, who are now the fourth and fifth accused in the case, will have to wait longer before their bail applications are heard.
The judge ordered that pre-bail assessment reports be prepared by a probation officer and filed within 30 days. Defence lawyers told the court they will present their final submissions after reviewing these reports.
The Office of the Director of Public Prosecutions, represented by State Counsel Gichuhi, opposed any bail terms for Ogola and Kuria, saying they had already filed an affidavit on July 18 objecting to their release.
To ease handling of the accused during the trial, the court granted a request for the transfer of Kuria and Ogola from Kamiti Maximum Security Prison to Nairobi Remand Prison.
Justice Kavedza also allowed the two to be held in different cells to help with coordination and security.
During the hearing, Kuria complained of feeling unwell, prompting the judge to direct that he receive immediate medical attention.
The case will be mentioned again on September 22, 2025, as the court reviews the progress on the bail matters for Kuria and Ogola.
