The Judicial Service Commission (JSC) has named Sukyan Omar Hassan as the Acting Chief Kadhi, taking over from the late Sheikh Athman Abdul-Halim, whose tenure was cut short by his death last month.

In a statement, the commission said the appointment took effect on August 8, 2025, following deliberations during its meeting on July 14 in line with Article 170 of the Constitution and Section 2 of the Kadhis’ Court Act.

“Sukyan Omar Hassan, Senior Principal Kadhi, has been appointed to act in the position of Chief Kadhi with effect from August 6, 2025. Omar will discharge all the duties and responsibilities of the Chief Kadhi during the acting period,” said Chief Registrar of the Judiciary Winfridah Mokaya.

Omar, who served as Deputy Chief Kadhi under Sheikh Abdul-Halim, will hold the position for three months or until it is filled substantively, whichever comes first.

The office fell vacant after Sheikh Abdul-Halim died on July 10, 2025, in Mombasa.

He had been appointed in July 2023 after a recruitment process that saw him chosen from five shortlisted candidates to succeed Sheikh Ahmed Muhdhar, who retired after 12 years in the role upon reaching the age of 60.

As the 11th holder of the office, Sheikh Abdul-Halim oversaw family matters among Muslims, including inheritance, divorce and marriage cases.

His work also involved translating Arabic documents, supervising Kadhi court registries, and maintaining official records of family-related rulings in collaboration with magistrates.

The Chief Kadhi position is a constitutional role within Kenya’s Judiciary, reserved for Muslims who meet specific qualifications. Candidates must hold a degree in Islamic Law, demonstrate good conduct in line with Islamic principles, belong to recognised Islamic associations, and meet the requirements of Chapter Six of the Constitution.
