High Court denies bail to Talaam and five accused in Albert Ojwang murder case

The High Court has turned down a bail request for former Nairobi Central Police Station officer Samson Talaam and five others accused in the murder of teacher and blogger Albert Ojwang while in police custody.

Delivering the ruling on Tuesday, Lady Justice Diana Kavedza ordered Talaam, Police Constables James Mukhwana and Peter Kimani, along with three additional suspects, to remain in custody as investigations into Ojwang’s death continue.

The prosecution had argued that granting bail could interfere with witnesses and disrupt ongoing investigations by agencies, including the Independent Policing Oversight Authority (IPOA). Justice Kavedza, however, rejected this claim, saying no evidence was provided to support it.

Addressing public safety, the judge noted that recent protests, property destruction, and the burning of a police station created serious risks. She warned that releasing the suspects at this point could put their safety in jeopardy.

“The court holds the sole discretion to balance public interest with the safety of the accused,” Justice Kavedza said.

The judge further highlighted that national security is a key concern and cannot be overlooked when considering bail. She stated that releasing the suspects now could spark public outrage and threaten stability, making bail an unsuitable option.

As a result, all six accused will remain in custody as the case proceeds.
