Former Deputy President Rigathi Gachagua has now shifted focus in his legal battle, asking the court to award him compensation for what he would have earned had he completed his five-year term in office.

This comes after his impeachment, which he now argues was unlawful.

Through his lawyer Paul Muite, Gachagua informed the court that he wishes to amend his initial petition by removing the request to be reinstated and instead pursue financial compensation.

"The petitioner wishes to challenge the legality of his impeachment and will be seeking leave to amend the prayers. He will be asking for the money he would have earned had he served the full five-year term," Muite told the court.

Muite told the court that Gachagua is no longer interested in any declaration for reinstatement and will not be filing any interlocutory application. He also asked the court to set an early hearing date.

"This petition is not a matter of public interest. It is a personal matter that directly affects the petitioner, who is the one impeached," he said.

The respondents did not object to Gachagua’s application to revise his petition.
