Senate sets August 20 sitting to hear charges against Governor Mutai

In a notice issued on August 18, Senate Speaker Amason Kingi confirmed that the sitting will take place at the Senate Chamber in Nairobi from 2:30 pm.
The Senate has scheduled a special sitting on Wednesday, August 20, to deliberate on the impeachment of Kericho Governor Eric Kipkoech Mutai.
In a notice issued on August 18, Senate Speaker Amason Kingi confirmed that the sitting will take place at the Senate Chamber in Nairobi from 2:30 pm.
He said the decision follows a request from the Senate Majority Leader, backed by the requisite number of Senators, and formal communication from the Kericho County Assembly notifying the Senate of Mutai’s impeachment.
The letter from Kericho County Assembly Speaker Patrick Mutai, dated August 15, detailed the resolution to remove the governor from office.
The Senate received the letter on August 18, accompanied by evidence, proceedings, and supporting documentation as required under law.
According to Speaker Kingi, the August 20 session will address three items: the swearing-in of Consolata Nabwire Wakwabubi as a nominated Senator under Article 98 (1)(b) of the Constitution, the hearing of charges against Governor Mutai, and the alteration of the Senate calendar.
He clarified that in line with Standing Order 33(5), the special sitting will strictly focus on the listed business. After the session, the Senate will adjourn until Tuesday, September 9, 2025.
Governor Mutai was impeached by all 33 members of the Kericho County Assembly in a unanimous vote held on August 15.
The motion cited abuse of office, misappropriation of public and donor funds, and irregular payments amounting to Sh85 million for incomplete or non-existent projects.
Despite mounting a spirited defence during the heated session, Mutai failed to sway the MCAs, who endorsed the motion tabled by Sigowet Ward MCA Kiprotich Rogony. The governor has strongly denied the allegations.
The impeachment proceedings had earlier been halted by the High Court in Kericho after petitioners questioned the legality of the process, but the case proceeded after the suspension was lifted.
The Senate will now decide whether to form a special committee to investigate the charges or proceed with a plenary hearing. If the House upholds the County Assembly’s resolution, Governor Mutai risks permanent removal from office.
