Two sentenced to 28 years in prison for defiling minor in Kilifi

A court in Kilifi has sentenced two men to 28 years in prison each after they were convicted of defiling a 16-year-old girl on February 9, 2025, in Mwambetsungu.
In a statement shared on X on May 27, 2025, the Office of the Director of Public Prosecutions (ODPP) identified the offenders as Gift Kalu Mwango, aged 21, and 19-year-old Emmanuel Kazungu Mganga.
According to the Office of the Director of Public Prosecutions (ODPP), the court was told that the girl had stepped out around 10:00 p.m. to retrieve her shoes when she was attacked by the two men, who were known to her as neighbours.
The prosecution revealed that the duo covered her mouth and dragged her into a nearby thicket. There, Gift Kalu Mwango defiled her while Emmanuel Kazungu Mganga brandished a knife, threatening to harm her if she resisted.
Chief Magistrate Charles Obulutsa found that all elements constituting gang defilement had been proven—specifically the victim’s age, the act of penetration, and the clear identification of both perpetrators.
Chief Magistrate Charles Obulutsa, in his ruling, stated that after reviewing both the prosecution and defence arguments, the court was convinced that the prosecution had proven the primary charge of gang defilement beyond reasonable doubt.
"The accused are hereby found guilty and convicted accordingly," he declared.
While the court acknowledged that Emmanuel Kazungu Mganga did not physically commit the defilement, it emphasized that he witnessed the incident unfold and had the opportunity either to intervene or leave the scene, but chose neither.
