Prominent lawyer and former Law Society of Kenya (LSK) President Nelson Havi has urged Kenyans to invoke the recall clause in the Constitution, citing a worrying trend of non-performance and silence among Members of Parliament.

Speaking during a televised interview with Citizen on Monday, July 21, 2025, Havi called for immediate action by the Independent Electoral and Boundaries Commission (IEBC) and the public, arguing that many MPs have failed in their legislative duties and no longer deserve to hold office.

“There are nearly 30 million Kenyans of voting age since the last credible election. That’s a huge bloc that must be reflected in the register and they have a right to demand accountability,” he said.

Havi criticized Parliament for failing to pass clear legislation to facilitate the implementation of the recall clause, which is enshrined in the Constitution. He pointed out that an earlier law attempting to operationalize the clause was struck down by the High Court.

“The Constitution gives citizens the right to recall their representatives. Unfortunately, Parliament abdicated its responsibility by failing to pass proper laws to support this process,” he said.

Highlighting dissatisfaction across various constituencies, Havi noted that many voters feel betrayed by MPs who switched political allegiance after the 2022 elections.

“As soon as this government assumed power, some legislators defected to Kenya Kwanza, disregarding the multi-party democratic principles. That is a serious issue,” he said.

He also took aim at MPs who are vocal at public rallies but invisible within the chambers of Parliament. “We have members who are always loud in the streets but have no record of meaningful contribution in the House. Why are they there? They should be recalled,” he said.

While acknowledging the legal and procedural difficulties in initiating a recall, including the need for a court judgment and the burden of collecting signatures, Havi maintained that citizens must push for this constitutional right.

“It’s not an easy process it’s complicated and intentionally obstructed. But it exists for a reason, and the time to invoke it is now,” he said.

He also called for accelerated voter registration and resolution of pending by-elections, insisting that the democratic process must be revitalized through citizen engagement and electoral reform.
