Former lands commissioner Sammy Mwaita arrested over Nairobi land fraud

Former Baringo Central MP and ex-Lands Commissioner Sammy Silas Komen Mwaita has been arrested in connection with a high-stakes land fraud case involving two prime properties in Nairobi West.
Mwaita was apprehended by detectives from the Directorate of Criminal Investigations (DCI) in the Kilimani area on Sunday 3rd Aug 2025 following fresh directives from the Office of the Director of Public Prosecutions (ODPP).
He is expected to face multiple criminal charges including conspiracy to commit a felony, forgery, abuse of office, and giving false information to a public officer.
In a statement released Sunday evening, the DCI confirmed the arrest, saying Mwaita is linked to fraudulent dealings over two multi-million-shilling plots located along Mai Mahiu Road in Nairobi West.
“Detectives have today arrested Hon. Sammy Silas Komen Mwaita at Kilimani for the offences of conspiracy to commit a felony, making a document without authority, abuse of office, and giving false information to a person employed in the public service,” the statement read.

Investigators say the two parcels at the center of the case are among Nairobi’s valuable land holdings and have been subject to conflicting ownership claims now believed to have stemmed from forged documentation and unlawful approvals.
Mwaita is currently in police custody as he undergoes formal processing ahead of arraignment. The DCI has also launched a manhunt for his alleged co-conspirator, whose identity is yet to be disclosed.
Authorities say the arrest underscores renewed efforts to clamp down on historical land fraud, especially cases involving former senior officials.
