The case filed by activist Khalef Khalifa against former IEBC chairperson Wafula Chebukati, Azimio leader Raila Odinga, and Wiper leader Kalonzo Musyoka will proceed despite Chebukati’s passing in February 2025.

The petition concerns alleged irregularities in the 2022 electoral process.

During a court mention before High Court Judge Lawrence Mugambi, Chebukati’s lawyer stated that he had not received instructions on how to proceed following his client’s death.

“I have not filed responses because the respondent is now deceased, and we are yet to receive instructions on how to proceed,” said the lawyer in a quote attributed to Citizen Digital.

The court also noted that the petitioner was required to file responses to an application related to the case.

High Court Judge Lawrence Mugambi directed all parties to submit their responses and filings before the next mention, scheduled for July 1, when a ruling date will be set.
