Court sets August deadline for Government to submit evidence on Adani tender

The High Court has given the government a final chance to produce proof that the tender awarded to the Adani Group for KETRACO projects has been canceled.

The court directed the respondents, particularly the Attorney General, to file and serve their responses to the case by August 1 this year.
Justice Mwamuye warned that if the required documents are not submitted by the deadline, the case will proceed to a full hearing.
The next mention of the case is scheduled for October 27, when further directions, including those on adding new parties to the case, will be issued.
The case stems from an order by President William Ruto last November, which instructed the Ministries of Transport and Energy to cancel the deals with the Adani Group.
Ruto’s order was based on new information from investigative agencies and partner nations, calling for the immediate cancellation of the ongoing procurement processes for the JKIA expansion and the KETRACO transmission line projects.
The president also directed that new partners be onboarded for these projects.
Adani had proposed a Sh260 billion deal to upgrade JKIA for 30 years and a Sh95 billion investment in transmission lines, both under the Public Private Partnership model.
The High Court had previously issued an order suspending the implementation of the agreement.
The case was filed by the Law Society of Kenya, which argued that the deals lacked proper public participation and may have violated constitutional rules on transparency and accountability.
