High court to give directions in blogger Kinyagia disappearance case

The High Court is today expected to give further directions in the habeas corpus case involving missing blogger Ndiangui Kinyagia, amid mounting pressure on police to explain his disappearance and reveal his whereabouts.

The court proceedings follow a directive issued on Monday by Justice Chacha Mwita, ordering Inspector General of Police Douglas Kanja to either produce Kinyagia in court or provide a credible explanation regarding his location.

The directive came after the Law Society of Kenya (LSK) filed a petition over what it termed as a troubling case of enforced disappearance.

Kinyagia was reportedly abducted on June 21 by masked individuals in unmarked vehicles outside his residence in Kinoo. Since then, his family and several rights organisations have raised the alarm, demanding his immediate release.

Amnesty International and activist Boniface Mwangi have both joined calls for his safe return.

Despite the growing concerns, the Directorate of Criminal Investigations (DCI) has denied holding Kinyagia. DCI Director Mohamed Amin stated that although the blogger was a person of interest over social media activity, he was not in their custody.

He added that officers had conducted a search at Kinyagia’s home and seized electronic devices, but claimed that the blogger was not found during the operation.

Justice Mwita directed the Inspector General to ensure all relevant responses are submitted by today, paving the way for the court to determine the next course of action in the case.

Meanwhile, the same court is today expected to hear a separate petition regarding the disappearance of Benedict Kabiru, a Kenyan police officer deployed to Haiti under the government’s peacekeeping mission.

The petition was filed by Kabiru’s mother, Jacinta Wanjiku Kabiru, and his uncle, Daniel Kabiru Ndung’u, who argue that the government's silence on his fate has caused them immense emotional distress.

They claim the state has failed to provide clear and consistent information about his well-being, adding that the uncertainty amounts to psychological torture and a violation of their rights. The family is asking the court to compel the government to confirm whether Kabiru is alive or dead and, if deceased, to disclose the location of his remains.
