Sarah Wairimu Kamotho will remain in custody after the High Court in Kibera denied her second attempt to be released on bond in the ongoing murder case of Dutch businessman Tob Cohen.

While delivering the ruling on Tuesday, Lady Justice Diana Mochache said Wairimu, who is accused of killing her husband in 2019, would continue to be held at Langata Women’s Prison until the defense can show a change in the situation that would justify a review of the earlier decision.

The prosecution, led by Acting Deputy Director of Public Prosecutions Vincent Monda, opposed the renewed bond application. The prosecution argued that she had intimidated witnesses, posed a flight risk, and interfered with the crime scene.

The court noted that Wairimu had fraudulently acquired a second passport while the original one was in the hands of police.

Based on this, the court ruled that she could potentially escape and interfere with witnesses if granted bond.

The judge also pointed out that no new or substantial reasons had been presented by the defense team to justify revisiting the issue of bail. The court stressed that the safety of witnesses and the integrity of the justice system must be upheld throughout the trial.

At the same time, the court gave the defense team permission to visit the crime scene, but under strict supervision to ensure that no evidence is tampered with.

Wairimu is accused of murdering her husband, Tob Cohen, on July 19, 2019, in the Lower Kabete area of Nairobi County. Cohen, a Dutch national, was found dead in a water tank at their home two months after he had been reported missing.

The case will be mentioned on July 30, 2025, when the court will give further directions on the way forward.
