Court suspends mandate of panel on protest victims’ compensation

The High Court in Kerugoya has temporarily suspended the operations of the Panel of Experts on Compensation of Victims of Demonstrations and Public Protests, pending the hearing of a petition challenging its legality.
The panel was appointed by President William Ruto to oversee compensation of victims of demonstrations and public protests.
In orders issued by Justice Dennis Kizito Magare on Monday, the court granted conservatory orders staying the commencement of the panel’s mandate as well as the implementation of Gazette Notice No. 12002 of August 25, 2025, which established the team.
The orders also bar the State from acting on President Ruto’s proclamation of August 6, 2025, that set up a framework for reparations and compensation of victims of demonstrations, public protests, and riots.
The ruling followed a petition filed by Levi Munyeri against the State Law Office, the Interior Cabinet Secretary, and two others.
The court certified the application as urgent and directed the parties to file their responses within seven days.
The 18-member panel, sworn in on September 4, 2025, is chaired by Prof. Makau Mutua, President William Ruto’s senior advisor on constitutional affairs and human rights. Its mandate is to facilitate compensation for victims of demonstrations and protests dating back to 2017.
Law Society of Kenya (LSK) President Faith Odhiambo serves as vice chairperson.
The matter will be mentioned for further directions on October 6, 2025, at the Kerugoya Law Courts.
